The State Court of Auditors (ECA) judged regulate the procedure for acquiring license of use of a software carried out by the State Data Processing Center of Mato Grosso (Cepromat). The decision makes up the process of annual organ of management who was tried and received legal requirements for improvement of internal control.

The defense of Wilson Celso Teixeira explained that through the work carried out by designated committee by Cepromat, the need for “regularization” of licenses used in computers and software to numerous agencies / entities in the state of Mato Grosso was found because they were acting without compliance with legal regulations.

In this sense, the process hiring agreed with the licensing program under which the company used a methodology called “Defining Microsoft Government Eligibility,” which provides the basis for particular customer within four price levels (A, B, C, D) with progressive discounts from the first to the last level, as commercial interest involved.

The rapporteur of the case, counselor Ricardo Seriously, accepted the defense’s arguments and dismissed the representation. “The acquisition of programs for education sector occurred through entities owned able to obtain deeper discounts, according to the policy of ‘eligibility’ of Microsoft company, meeting the legal requirements.”

The vote of the rapporteur was judged unanimously.
